International Commercial Arbitration

BD&P’s International Commercial Arbitration Team advises corporate clients on dispute resolution regimes and the drafting of arbitration agreements. This Team has represented companies and states involved in international commercial arbitrations touching on a variety of industries, including aeronautics, manufacturing, telecommunications and oil & gas. The Team is experienced in representing clients in ad hoc arbitrations under the UNCITRAL Rules as well as in institutional arbitrations administered pursuant to the rules of the ICC and Stockholm Chamber of Commerce.

Members of the Team also appear before Canadian courts in matters arising out of international commercial arbitrations, including the areas of

    • recognition and enforcement of awards under the UNCITRAL Model Law and the New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards, in particular in relation to sovereign immunity, limitation periods and public policy, and
    • court assistance in, and supervision of, arbitral proceedings.

The leader of the International Commercial Arbitration Team, David Haigh, Q.C., also serves as arbitrator on international commercial arbitration tribunals. He has served or is serving on tribunals hearing ad hoc cases under the UNCITRAL Rules, as well as institutional arbitrations under the ICSID ICC, LCIA, AAA and BCICAC Rules.
