Occupational Health & Safety

BD&P lawyers on the Occupational Health and Safety Team are recognized leaders in the area, with wide-ranging experience in all of its aspects. Knowledgeable in current legislation and case law, this Team regularly provides advice to companies and executives in those industries at risk of accidents in the work place. The Occupational Health and Safety Team assists clients in the development and monitoring of comprehensive health and safety programs for clients and in the development of appropriate responses to OH&S investigations and/or charges.

With particular focus in the oil and gas industry, this Team recognizes the benefit to the employer of a comprehensive health and safety program in terms of Worker Compensation costs, business interruption costs, reputation in the work place, and the time and costs associated with OH&S prosecutions.

Significant Areas of Service

  • Review and development of Occupational Health and Safety programs for employers
  • Advise on interpretation, application and compliance matters with Provincial and Federal Occupational Health and Safety Legislation
  • Assist clients in the proper response to and reporting of accidents
  • Assist clients in their response to prosecutions brought pursuant to Provincial or Federal Occupational Health and Safety Legislation
  • Provide Occupational Health and Safety information and seminars to meet a client's specific needs

  • Counsel to the owner of a multi-unit residential construction project with a Safety Codes Act violation that involved a charge against both the owner and its general contractor.
  • Counsel to an oilfield service company facing charges under the Occupational Health and Safety Act related to the failure of a kelly hose that severed a worker's leg.
  • Counsel to an oilfield service company facing charges under the Occupational Health and Safety Act related to a fall from height.
  • Counsel to an oilfield service company facing charges under the Occupational Health and Safety Act related to injuries sustained by a worker when an improperly secured circulating assembly fell from the derrick of a service rig.
  • Counsel to an Exploration and Production company facing charges under the Occupational Health and Safety Act related to injuries sustained by a subcontractor's worker when an explosion occurred as a result of a faulty propane heater brought to a worksite by the subcontractor.
  • Counsel to an oilfield service company carrying out an investigation into the circumstances surrounding a vehicle accident fatality as mandated by the Occupational Health and Safety Act.
  • Counsel to an oilfield service company facing charges under the Occupational Health and Safety Act related to a fatality suffered when a worker was struck by an iron roughneck that dropped and struck him on the head.
  • Counsel to various Exploration and Production companies undertaking audits of their health and safety policies and processes.
