Experience

Don transitioned from partner to counsel effective January 1, 2013. With over 50 years at the Alberta Bar, Don provides mentoring and practical advice on litigation matters to junior lawyers and students and is available to provide assistance to all BD&P lawyers in insurance, franchise law, and construction law issues. He also acts as counsel on a number of large litigation files.

Professional history

  • Counsel and adviser for over 50 years to a wide range of the national and international insurers who carry on business in Canada in relation to all forms of insurance matters including litigation, insurance coverage issues, insurance policy and legislation interpretation
  • Don has acted on a number of high profile, major litigation matters on behalf of construction companies, insurance companies and their insureds in both the provinces of Alberta and British Columbia for several decades
  • Wide ranging experience in relation to negotiating, mediating, arbitrating and litigating a wide variety of franchise disputes
  • Experienced in dealing with consumer groups and government agencies in relation to franchise insurance related matters
  • Counsel and adviser for over 50 years in relation to construction matters, advising on a wide range of commercial and industrial construction projects
  • Defended a wide range of sports related litigation and was defence counsel in the current leading decision in Canada in connection with the law of waivers
  • Advised on all forms of professional malpractice litigation, including medical, engineering and accounting
  • Advised on many product liability issues connected with major project litigation files, often involving commercial and industrial product failure and issues related to the duty to warn
  • Has had significant involvement in mediation and arbitration of commercial insurance disputes as well as serving as expert witness in such disputes
