Representative work
Ganong v Northwynd REIT et al
Counsel for the plaintiff class members in Ganong v Northwynd REIT et al. This action was successfully certified as a class proceeding in 2021. The plaintiff class, consisting of hundreds of unitholders who invested over $40 million in Northwynd REIT, alleged that at the time of the wind-up in 2017, Northwynd had about $40 million in contingent assets. Instead of distributing these assets to the unitholders, the trustees transferred them to a holding company owned by Northwynd's CEO for no consideration. A favourable settlement was reached in November 2024, with the distribution of settlement proceeds to be completed in 2025.
Certification of national class action
Successfully obtained certification in British Columbia of a national class action against manufacturers of natural health supplements and Court approval of a settlement against another manufacturer. (Krishnan v Jamieson Laboratories Inc., 2021 BCSC 1396, 2921 BCSC 1425, 2021 BCSC 2127, 2023 BCCA 72, leave to appeal to SCC denied).
Historic settlement in workplace sexual misconduct class action
Counsel for plaintiff class in successful settlement with the City of Leduc for systemic sexual abuse, harassment, and assault against female city employees, including firefighters. Terms of settlement include the highest per-person monetary compensation in a Canada class action settlement for workplace misconduct. This is the first class action settlement for workplace sexual misconduct involving a municipality as well as first involving a fire department in Canadian history.
